2018 President's Message

We expect this year to be another challenging year for NUCA Pennsylvania as we strive to keep our members informed on a wide range of legislative and regulatory issues that can have a profound impact on our industry and your employees. We monitor the Pennsylvania Infrastructure Investment Authority (PENNVEST), the Department of Environmental Protection for regulations and technical guidance changes. We participate on the PA One Call System Board and their Committees. We attend the Commonwealth Finance Agency meetings and participate in Legislative hearings on utility and business related industry issues. We are trying to change the DBE Solicitation process to a self-help process through an online bid process. PennDOT's ban on the use of excavator-mounted hydraulic compactors was resolved on November 22, 2013, when we received PennDOT's Strike-off letter lifting the ban. We completed the PennDOT hoe pac study using the smallest hoe pac to achieve a 12" maximium lift height. PennDOT has a draft proposal accepting a maximum 8" lift for trench backfilling, continued inspections during backfill process, then again in 2 years. In addition, we are in the process of working with PennDOT to revise the Pub. 459 Highway Occupancy Permit regulations. Our meetings are expected to be completed by the end of 2017.
On the legislative front, we are fighting to protect the work of utility contractors throughout the Commonwealth by lobbying against a Plumbers' Licensure bill that contains a very broad definition of "plumbing services." The PA One Call law is on the table again for 2017. This is another top priority for utility contractors.
In 2015 we began Leadership training directly related to the industry. This training series will continue in 2016. We also plan to provide indirect personnel management training to help your employees hone their personal skills for future growth within your company. This training will be offered for executive, mid-management and field personnel. This trainer holds a PHD in Psychology with many years of teaching experience.
From passing along vital regulatory information and case law, to meeting with Pennsylvania’s Congressional Delegation, to representing utility and excavation industry before the Pennsylvania General Assembly, working with various coalitions- such as the Delaware Valley Common Ground Alliance Regional Partnership, the Pennsylvania Infrastructure Group, to networking with other professional and trade associations that can help us achieve our advocacy goals; NUCA Pennsylvania is in the trenches with you.
In 2015 we began offering Leadership workshops directly related to the industry. We plan to continue with more leadership training for your executive, mid-management and field employees on both direct industry related training as well as indirect personnel management training.
Everyone reaps the reward when we all renew our membership in the Association. We also partnered with Drexel University for discounted online construction management courses for our members. They agreed to extend this discounted rate to NUCA PA members for other online curriculmn too!

The Pennsylvania Utility Contractors Association now D/B/A NUCA Pennsylvania has been the voice of the utility industry for sewer and water contractors, suppliers, professionals in the industry, and governmental entities for over 40 years. We have been able to define, establish and preserve the identity and the common interests of the utility industry through our promotion of the industry with governmental agencies, general contractors, labor and professional engineers. Our mission is to provide funding for utility projects, fair and reasonable contract specifications, timely payments on work performed, fair bidding practices, subsurface utility locating and a favorable law and regulatory environment. |

Safety training is the cheapest labor cost. One safety violation or accident can put your company out of business. The NUCA PA realizes you need to provide this important education, that's why we offer safety training at discounted rates for our members. These seminars usually run through the fall and winter months when work is slower. Competent Person, Confined Space Entry, OSHA 10-hour Training, Trench Rescue are our most popular training seminars. NUCA Safety Manuals are available to help your company start a safety program that complies with OSHA Requirements.

You can't fight city hall alone! But we can fight together! The NUCA PA has undertaken numerous legal issues that affect the utility industry as a whole. We challenged the mis-marks of utility services by facility owners, several project labor agreements and the Pennsylvania sales tax on materials and equipment. These issues continue to need our combined efforts for even greater success.

You're too busy running your business to keep in touch with what's happening in the industry! Let the NUCA PA track the industry issues for you. We follow the state issues and keep you up-to-date on any changes in regulations, policies or laws that affect your business. The E-Info is emailed or faxed to our membership with pertinent information for your company. Newsletters bring articles to your doorstep that improves your company's productivity, management, safety, and financial status. A website at www.nucapa.org permits the dissemination of information 7 days a week, 24 hours a day. And you can email questions or requests to the office at your convenience.

GOVERNMENT |
Do you have the time to attend every legislative and regulatory hearing that affects the utility industry? That's why you need to join NUCA PA. Our goal is to represent the common interests of the utility contractors at hearings, meetings and conferences throughout the state. NUCA PA testified before a Joint State Government Committee on "Infiltration and Inflow". We were instrumental in having the Committee form the "Infiltration Task Force" to address the sewer and water needs for Pennsylvania. NUCA PA also facilitated the passage of the Pennsylvania One Call Law, which provides for certain contractor protections under the law. And, we acquired the passage of the Pennsylvania Infrastructure Investment Authority (PennVest) that provides funding for many of our sewer and water projects. To stay abreast of these issues, NUCA PA members volunteer to appointed governmental boards to advise these boards of the utility industry's interest.

PUBLIC |
Ask the average person on the street what is a utility contractor? The answer you will probably get: The phone company or the power company. The NUCA PA promotes the utility industry statewide. Usually the public only hears about utility contractors when an emergency repair service needs to be provided. The NUCA PA is facilitating the public awareness of our industry. We held the first groundbreaking ceremony in the state for a sewer project. The public heard the term "utility contractor" on the local news and it was associated with economic development for the region.

The NUCA PA encourages our members to practice good public relationship techniques at every job site. This public relationship has the greatest impact for the industry and your company. The good or bad restoration at a job site is the perceived public perception of a company. The NUCA PA teaches negotiation techniques that help our members resolve those difficult situations.

A good business practice is to treat others, as you would like to be treated! The NUCA PA members promote ethical practices among utility contractors and with the general public.

The NUCA PA is a charter member of NUCA. Our partnership with NUCA gives you access to federal issues, safety training, industry training, and business management for an annual fee.
